Do I stop paying my creditors if I want to enter Sequestration?

If you do not stop paying your creditors it is unlikely that any of them will take you to court and so you won’t meet the criteria to enter into bankruptcy. Even if you make token payments, this will usually stop or greatly postpone any court action. 

However even through stopping paying, it can take a year or even more for a creditor to take court action against you. It should be noted that there was a change in the law approximately three years ago which has put a stop to certain recovery action. This action would be used if you had a Decree issued against you, and it meant if you stopped paying this particular debt the Sheriff court could send officers to your property and they would make an inventory of any assets you own. For example televisions and computers. They could then remove and sell these goods literally from under your feet. This law has now been abolished and there is no need to have any concern over this sort of action
